What is a fiducie ?

The fiducie is a legal mechanism established by French Law No. 2007-211 of February 19, 2007. It enables an individual or a company, known as the settlor, to temporarily transfer assets, rights or security interests to a fiduciaire (fiduciary).

These assets are placed into a separate estate, known as the fiduciary estate, which remains entirely distinct from the fiduciaire’s own assets.

This secure and rigorously regulated framework ensures that assets are administered in accordance with the objectives defined in a fiducie agreement, whether for protection, management, enhancement or security purposes.

The fiducie can be implemented in two main forms, tailored to the specific needs of each situation.

Management Fiducie

A Tool for Managing , Protecting and/or Transferring Assets

Management Fiducie allows a settlor to transfer assets to a fiduciaire while remaining the beneficiary of the income or profits generated by those assets. This arrangement is particularly suited to families and businesses seeking to optimize the management and transmission of their wealth.

It is especially relevant in situations involving the management of assets located in France and owned by non-residents, whether directly or through an intermediary structure, estate planning and wealth transfer, the governance of relationships between business partners, or the administration of assets belonging to vulnerable individuals.

Under this arrangement, the fiducie agreement is entered into between the settlor, who also acts as beneficiary, and the fiduciaire.

This mechanism is particularly useful for:

Security Fiducie

A Robust Mechanism
for Securing Debt Repayment

Security Fiducie is a widely used legal mechanism in financing transactions.

It enables a debtor (the settlor) to transfer assets as security for an obligation owed to a creditor (the beneficiary). If the secured obligations are not fulfilled, the assets may be transferred to the beneficiary in satisfaction of the claim.

Under this arrangement, the fiducie agreement is entered into by three parties: the beneficiary (creditor), the settlor (debtor), and the fiduciaire, who is responsible for administering the arrangement in accordance with the terms of the agreement.

While Management Fiducie and Security Fiducie serve different purposes, both operate within a rigorous legal framework designed to ensure security and transparency for all parties involved.

At the conclusion of the fiducie, any proceeds or benefits generated within the fiduciary estate are redistributed to the settlor or, where applicable, to a designated third-party beneficiary.

The Security Fiducie is particularly suitable for:
